ChatGPT

Vendor version: gpt-5.5 (as of 29 August 2026)

OpenAI's GPT family is the best-known name of the AI wave and familiar to many staff from private use - the interface and answering style are known quantities, so training time is short. Under professional-secrecy law, everything depends on the route: the contractual chain is closed via Azure and nowhere else. There, the confidentiality undertaking is signed in text form with instruction on criminal liability, and inputs do not flow into model training. Buying directly from the vendor lacks exactly that element - no publicly available document could be found as of the July 2026 research date - and the free consumer access has neither a data processing agreement nor a confidentiality undertaking.

Available through us EUR 3.16 per million tokens

Everything section 203 requires is settled, including the provider's confidentiality undertaking. You do not have to clarify anything further.

What it is good for

  • Highest recognition inside the firm - ChatGPT is the entry point everyone already knows
  • Broad task coverage from drafting work to research preparation
  • Contractual line via the vendor's standardised professional-secrecy amendment

Where it stops

  • The confidentiality undertaking is signed through our contractual line and covers the Azure models; setting it up in your own tenant is part of the onboarding
  • Switching off human abuse review is tied to Microsoft eligibility (Microsoft-managed/EA)
  • CLOUD Act exposure remains - the third-country module is mandatory

Routes examined

The same model, procured differently, is a different legal position. What is examined per route is the contract chain, not the model.

Route Section 203 status Version on this route
Microsoft Azure covered -
Direct purchase from the vendor (business customers) conditional -
Consumer access (free or private subscription) not covered -

The conditions behind a conditional status - which piece is open on which route and who closes it - are set out in the full matrix in the German catalogue, and we go through them in the conversation. The German page for ChatGPT carries the sources with their retrieval dates.
